1. Who you are agreeing with
Vizi Player is published by OMWSD LTD, a private limited company registered in England and Wales under company number 17452769, whose registered office is 27 Millfield Road, Albrighton, Wolverhampton, WV7 3JN, England. In these terms “we”, “us” and “our” mean OMWSD LTD. You can reach us at support@viziplayer.com.
2. What Vizi is
Vizi is a media player for iPhone, iPad and Apple TV, and for Android phones, tablets and TVs. It supplies no content of its own beyond a small invented demo library, comes with nothing pre-loaded, and provides no directory, search or recommendation of places to obtain media. It has no affiliation with anyone who supplies media. It does not host, cache, index, transmit or modify anything you play: media travels directly between your device and a server you have chosen and configured.
3. Your responsibilities
You are responsible for everything you add to Vizi and everything you play through it. By using it you confirm that you have the right to access and play that material, and that doing so is lawful where you are. Your use must comply with our acceptable use policy, which forms part of these terms.
Vizi is intended for personal and private use.
4. Accounts
An account is optional; on iPhone and iPad you need one for kids profiles. Each account is limited to five active devices at a time. You must give an email address you control. You may delete your account from the Vizi app on a phone or tablet at any time, and it is a real deletion — see deleting your account.
We may suspend or close an account that breaches these terms or the acceptable use policy. Where we reasonably can, we will tell you why.
5. Vizi+
Vizi+ is bought through Apple's App Store, Google Play or the Amazon Appstore, either as a subscription or as a single Lifetime payment (below). The store you buy through bills you: Apple, Google or Amazon, as applicable. A subscription renews until you cancel it — in your Apple account settings for the App Store, in the Play Store under Payments & subscriptions › Subscriptions for Google Play, or in your Amazon account, under your Appstore subscriptions, for the Amazon Appstore. Refund requests go to that store, under its own policies; we cannot cancel or refund a store purchase for you. On phones and tablets the free tier shows adverts, and an advert may be exchanged for a limited period of Vizi+ features.
Vizi+ Lifetime
What you get. Vizi+ Lifetime is a single payment for the Vizi+ features we offer on the day you buy it, with no subscription to renew. It belongs to the Apple ID, Google account or Amazon account you buy it with, and to your Vizi account where you are signed in to one.
What "lifetime" means. It lasts for as long as we provide Vizi and Vizi+. It is not a promise that Vizi, Vizi+ or any Vizi app will be available for any particular length of time.
Features. Vizi+ Lifetime covers the Vizi+ features available on the day you buy it. We may change, update, replace or withdraw features over time. We may also add new features, and it is up to us whether they are included in Vizi+ Lifetime, left out of it, or offered separately for an extra charge.
If Vizi changes or stops. We may stop offering Vizi, Vizi+ or any Vizi app, on one platform or on all of them, for any reason: for example if an app is removed from a store, if we stop supporting a platform while others continue, or if we stop trading. Vizi+ Lifetime ends on any platform where Vizi+ ends.
Refunds. Vizi+ Lifetime is bought through Apple's App Store, Google Play or the Amazon Appstore, and they handle payments and refund requests under their own policies. We do not give refunds, credits or compensation because a feature changes, is withdrawn or is not included, or because Vizi, Vizi+ or a Vizi app is withdrawn or ends, except where the law requires us to.
Your statutory rights. Nothing in these terms affects your statutory rights, including those under the Consumer Rights Act 2015.
6. Availability
Vizi is provided as it is. Whether any particular playlist or server works depends on that server, which is not ours and not within our control. We do not warrant that any media will be available, and we are not liable for it being unavailable, interrupted or different from what you expected.
7. Liability
We are not liable for anything you play, for any consequence of playing it, or for any loss arising from a server being unreachable, changed or withdrawn. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
8. Intellectual property
The Vizi name, logo and app are ours. Nothing in these terms gives you any right in anyone else's material, and using Vizi gives you no licence to anything you play through it.
9. Changes
We may change these terms. Where a change materially affects you we will say so in the app or by email before it takes effect. Continuing to use Vizi after that is acceptance.
10. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer elsewhere, this does not remove protections you have under your own local law.
